Description

It is obvious that sometime during your lifetime you will become involved either in court, being deposed or as a witness for your patient.

NBFE has created a series of sessions, via the Webinar, for teaching Students, Interns and Mental Health Professionals how-to behave in court. NBFE will show you how to enhance your courtroom skills and knowledge while under the gun of a deposition.  You will understand the difference between a FACT and EXPERT witness.

When a clinician is subpoenaed to appear, it is essential to identify what role the clinician will fulfill. When the clinician is qualified as an expert witness, the clinician may render opinion about the case, be subject to hearsay, exceptions, and address the ultimate issue. Generally, individuals performing forensic mental health evaluations will be considered expert witnesses. However, a therapist in a clinical case is generally considered a Fact witness who can only report on the facts of the therapy without rendering opinions, being subject to the hearsay exception, or addressing the ultimate issue. Only the judge or jury can decide the weight and credibility of the expert testimony.

LAY WITNESS: The LAY or non-expert witness is generally restricted to testify about facts (what he or she has directly experienced or observed). The LAY WITNESS is an ordinary person who testifies based upon their personal knowledge and life experiences. Only the expert witness can offer opinions or conclusion as to whether the individual was mentally ill at the time.

You will be called upon to become involved in the court experience during your the lifetime of your career.

4. List "tricks" the opposing counsel may use during depositions.

Norman E Hoffman, PhD, EdD, LMHC, LMFT

A man who saw the potential, an innovator, pushing the boundaries to advance the cause of licensed professional counselor in the field of forensic mental health. He had the vision, the success in his field, sometimes overcoming great challenges to pave the way for those seeking status and professional recognition in a field of forensic mental health that has in the past been inaccessible.

Dr. Hoffman is considered a pioneer with his passion and creativity to develop the pattern for those who pursue a role as an expert forensic mental health expert witness, having founded the national Board of Forensic Evaluators, created the Certified Forensic Mental Health Evaluator (CFMHE) credential, developed the Hoffman Organicity Test (HOT) to differentiate between schizophrenia and other organic brain disorders.

Dr. Hoffman  developed and validated the Child & Adolescent Forensic Screening Inventory  (CAFSI), meticulously designed to support professionals in conducting thorough and effective clinical interviews with children and adolescents within forensic contexts, ensuring that critical information is gathered accurately and efficiently.
